Terms of Use

These Terms of Use ("Terms") govern the use of the websites, pages, and mobile applications published by Artiwa Nova L.L.C ("Artiwa Nova", the "Company", "we", "us"), together with the related content, features, and services (collectively, the "Services"). If you do not accept these Terms, do not use the Services.
The Services may be offered by Artiwa Nova alone or under different product/brand names; regardless of the name under which they are offered, these Terms shall apply unless expressly stated otherwise.
1) Definitions
- User / You: The natural or legal person using the Services.
- Content: All materials such as text, images, videos, logos, designs, software code, interface, documentation, and similar materials.
- Account: A user account created to use certain Services.
2) Acceptance of the Terms
By accessing or using the Services, you accept these Terms and the policies incorporated by reference (e.g., the Privacy Policy, Cookie Policy). The Terms shall be applied in a manner consistent with the principles governing contractual relationships and obligations under Kosovo law.
3) Eligibility and Use
You may use the Services only in compliance with applicable laws. Age limits or additional conditions may apply to certain parts of the Services. If the Services are not designed for children, parental/guardian consent and the relevant legal requirements may apply.
4) Accounts, Security, and Responsibility
For Services that require you to create an Account, you agree to:
- provide accurate and up-to-date information,
- keep your login credentials confidential, and
- be responsible for activities carried out through your Account.
If you suspect unauthorized use, you must notify us immediately.
5) Scope of the Services, Changes, and Availability
The Services may be updated, improved, and partially or fully modified over time. Access to the Services may be temporarily restricted for maintenance, security, or technical reasons. Certain rules regarding services provided electronically may be assessed within the framework of Kosovo legislation on information society services.
6) License and Intellectual Property
Unless expressly stated otherwise, the Services and all Content belong to Artiwa Nova (or its licensors). You are granted a limited, non-transferable, non-exclusive license to use the Services in accordance with your personal or commercial purpose, subject to these Terms.
The following are prohibited:
- copying, reproducing, selling, or renting the Content or software,
- reverse engineering or attempting to derive source code,
- removing trademarks, logos, or copyright notices.
7) Prohibited Use
You may not use the Services for:
- unlawful activities,
- exploiting security vulnerabilities or unauthorized access to systems,
- overloading the Services in a way that prevents operation (DDoS, etc.),
- fraud, misleading statements, impersonation,
- infringing others' rights (copyright, trademark, personality rights, privacy).
8) User Content (If Applicable)
If you are allowed to upload/transmit content on the Services, you agree that:
- you have the necessary rights to the content you share,
- the content is lawful, and
- the content may be technically processed for the purpose of providing/improving the Services.
Unlawful content or content that infringes rights may be removed and access may be restricted.
9) Third-Party Services and Links
The Services may link to third-party sites/services or use third-party infrastructure (hosting, analytics, payments, notifications, etc.). Artiwa Nova is not responsible for third parties' content or practices; third parties may be subject to their own terms and policies.
10) Fees, Payments, and Subscriptions (If Applicable)
Some Services may be paid. Fees, billing periods, cancellation conditions, and any refund/return rules (if any) are stated on the relevant Service screen or in additional terms. For consumer transactions, mandatory rights under Kosovo consumer protection legislation remain reserved.
11) App Store / Google Play Specific Terms
If you download mobile applications via Apple App Store or Google Play:
- app use may also be subject to the relevant store's terms,
- your contract with Artiwa Nova is these Terms; store providers are not a party to the contract unless legally required,
- due to store rules, payment/subscription processes may be carried out through the store's infrastructure.
12) Privacy and Cookies
Processing of personal data is carried out under our Privacy Policy. Cookies and similar technologies are explained under our Cookie Policy. In Kosovo, personal data protection and user rights are assessed under the applicable law.
13) Limitation of Liability
The Services are provided "as is" and "as available." To the extent permitted by law, Artiwa Nova does not warrant:
- uninterrupted/error-free operation of the Services,
- fitness for a particular purpose,
- uninterrupted availability of third-party services.
To the fullest extent permitted by law, Artiwa Nova limits its liability, including for indirect damages (loss of profit, loss of data, loss of reputation, etc.). This provision does not affect liabilities that cannot be excluded under consumer legislation or mandatory legal provisions.
14) Indemnity
If Artiwa Nova suffers loss due to your breach of the Terms, unlawful use, or infringement of third parties' rights, you agree to indemnify Artiwa Nova for the reasonable losses, costs, and claims incurred (without prejudice to mandatory rules of law).
15) Suspension and Termination
In cases of breach of the Terms, security risk, or legal obligation, we may temporarily suspend or terminate your account or access to the Services. You may also terminate your account/use via in-Service options or by contacting us.
16) Updates to the Terms
We may update these Terms from time to time. The current text becomes effective as of the date it is published on our website/in the application. For material changes, we may provide notice to a reasonable extent.
17) Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Kosovo. In disputes, the competent courts in Kosovo shall have jurisdiction, without prejudice to mandatory provisions.
